SWARNA MANDAPA
TERMS OF RENTAL
INTRODUCTION
These Terms of Rental apply to all direct bookings made with Swarna Mandapa and arranged by PT Bali Stay Happy (“Swarna Mandapa”, “we”, “us” or “our”).
Bookings made through third-party booking platforms including, but not limited to, Airbnb, Booking.com, Expedia and their affiliated partners remain subject to the payment, booking and cancellation conditions of those platforms. Where those conditions differ from these Terms, the booking platform’s conditions shall prevail.
By confirming a booking, making payment or occupying the property, the Guest acknowledges that they have read, understood and agree to these Terms of Rental.
1. Reservations and Bookings
Reservations are accepted in good faith and are subject to availability.
The person making the reservation confirms that they are at least eighteen (18) years of age and accepts these Terms of Rental on behalf of all persons included within the booking.
2. The Residence
Swarna Mandapa is a privately owned, fully furnished, self-catered luxury residence located in Ungasan, South Kuta, Bali.
The residence is provided exclusively to the Guest for holiday accommodation and may not be used for any other purpose unless approved in writing by PT Bali Stay Happy.
3. Property Condition
The residence will be presented in a clean, well-maintained and fully prepared condition.
Guests agree to leave the residence in a reasonably clean and tidy condition upon departure.
Guests are responsible for cleaning kitchen utensils, cookware and appliances used during their stay and placing rubbish in the designated collection area before departure.
4. Occupancy
The number of overnight guests must never exceed the number confirmed on the booking confirmation.
Only registered guests may occupy the residence unless prior written approval has been obtained.
Failure to comply with this clause may result in immediate termination of the booking without refund.
5. Check-in and Check-out
Check-in is available from 3:00 pm.
Check-out is required by 10:00 am.
Alternative arrival or departure times may be arranged only with prior written approval and are subject to availability.
6. Payment
Full payment (100%) is required to confirm all direct bookings.
A surcharge of 3% applies to payments made by credit card.
Guests may alternatively pay by bank transfer where available to avoid credit card charges.
No reservation is confirmed until payment has been successfully received.
7. Security Deposit
A refundable IDR 5,000,000 Security Deposit is payable upon arrival.
The Security Deposit may be applied towards:
- Damage to the property
- Breakages
- Missing items
- Additional cleaning
- Excess rubbish removal
- Unauthorised late departure
The Security Deposit will be refunded following departure inspection less any authorised deductions.
The Security Deposit does not limit the Guest’s responsibility for the full cost of repairing or replacing damaged property.
8. Damage and Breakages
Guests are responsible for any damage, breakage, loss or deterioration occurring during their stay, whether caused intentionally or accidentally by themselves or any member of their party.
Damage should be reported immediately.
Where repair or replacement is necessary, the Guest agrees to reimburse PT Bali Stay Happy for all reasonable costs incurred.
9. Guest Responsibilities
Guests agree to:
- respect the residence
- respect neighbouring properties
- comply with Indonesian law
- supervise children at all times
- secure the residence when absent
- report maintenance issues promptly
10. Respect for Neighbours
Swarna Mandapa is located within a traditional Balinese village.
Guests are expected to respect neighbours, local customs and village life.
Noise should be kept to reasonable levels, particularly during evening and early morning hours.
11. Smoking
Smoking and vaping are strictly prohibited inside the residence.
Smoking is permitted only in designated outdoor areas.
Guests may be charged for specialised cleaning where smoke odour remains inside the residence.
12. Pets
Pets are not permitted unless specifically approved in writing before arrival.
Guests remain responsible for any damage or additional cleaning arising from approved pets.
13. Parties, Weddings and Events
Parties, weddings, commercial gatherings and events are not permitted without prior written approval.
Unauthorised events may result in immediate termination of the booking without refund.
14. Illegal Activities
The residence must not be used for any unlawful, dangerous or inappropriate purpose.
This includes, but is not limited to:
- Illegal drugs
- Drug manufacture
- Drug cultivation
- Drug distribution
- Gambling
- Prostitution
- Human trafficking
- Money laundering
- Possession of prohibited weapons
- Storage of stolen property
- Any activity prohibited under Indonesian law
Any breach may result in immediate termination of the booking without refund and may be reported to the relevant Indonesian authorities.
15. Pornographic or Sexually Explicit Content
The creation, recording, live streaming or distribution of pornographic, sexually explicit or adult entertainment material at Swarna Mandapa is strictly prohibited.
This includes professional productions, amateur productions, subscription content, live streaming and any similar activity intended for commercial or public distribution.
Any breach will result in immediate termination of the booking without refund.
Guests will be liable for all reputational damage, legal costs and financial losses arising from such activity.
16. Commercial Photography and Filming
Personal holiday photographs and videos are welcomed.
Commercial photography, commercial videography, influencer campaigns, advertising, product launches, television production, music videos, drone filming, workshops or any commercial activity require the prior written approval of PT Bali Stay Happy.
Additional fees and separate conditions may apply.
17. Artificial Intelligence and Digital Content
Guests must not create, publish or distribute AI-generated, digitally manipulated or misleading content that falsely represents activities occurring at Swarna Mandapa or that may damage the reputation of the residence.
Nothing in this clause prevents Guests from editing or sharing genuine holiday photographs.
18. Protection of Reputation
Guests must not use the Swarna Mandapa name, branding, photographs or location in connection with unlawful, defamatory, misleading or offensive material.
Guests remain responsible for any reputational damage caused through misuse of the property or its identity.
19. Social Media
Guests are welcome to share their experiences.
Where guests tag or mention Swarna Mandapa, PT Bali Stay Happy may request permission to share publicly available content for promotional purposes.
No guest content will be reproduced without permission.
20. Cancellation Policy
Bookings made through Airbnb, Booking.com, Expedia or other booking platforms remain subject to the cancellation policy of that platform.
For bookings made directly with Swarna Mandapa:
- Full payment is required at booking.
- Cancellations received more than fourteen (14) days before arrival receive a refund less a 15% administration fee together with any applicable bank or credit card charges.
- Date changes requested more than fourteen (14) days before arrival may be made without penalty, subject to availability and seasonal pricing differences.
- Cancellations received within fourteen (14) days of arrival are non-refundable.
- There are no refunds for early departures or no-shows.
- Date changes requested within fourteen (14) days of arrival are entirely at the discretion of Swarna Mandapa.
21. Refunds
Approved refunds will be made only to the original payment method or the originating bank account after verification.
Bank charges and card processing fees are non-refundable.
22. Property Availability
Should circumstances beyond the reasonable control of Swarna Mandapa prevent the residence from being made available, every reasonable effort will be made to provide suitable alternative accommodation.
Where no suitable alternative is available, all monies paid will be refunded in full.
This shall constitute the full extent of PT Bali Stay Happy’s liability.
23. Force Majeure
Force Majeure includes war, terrorism, epidemic, pandemic, severe weather events, natural disasters or government-imposed travel restrictions preventing travel.
International Guests are strongly encouraged to maintain comprehensive travel insurance.
Domestic Indonesian Guests may, at the sole discretion of Swarna Mandapa, be offered a date change or booking credit.
Travel advisories or airline cancellations alone do not constitute Force Majeure.
24. Right to Refuse or Terminate a Booking
PT Bali Stay Happy reserves the right to refuse any booking or terminate any stay where it reasonably believes that a Guest has breached these Terms, provided false or misleading information, or is using or intends to use the property in a manner that is unlawful, unsafe or likely to damage the property or the reputation of Swarna Mandapa.
Where a booking is terminated for breach of these Terms, no refund will be payable.
25. Limitation of Liability
Neither Swarna Mandapa, PT Bali Stay Happy, nor their directors, employees or representatives shall be liable for any loss, damage, injury, delay or inconvenience arising from events beyond their reasonable control.
Guests remain responsible for their own travel insurance, personal belongings and personal safety.
26. Governing Law
These Terms of Rental are governed by the laws of the Republic of Indonesia.
Any dispute arising from these Terms shall be subject to the jurisdiction of the Indonesian courts unless otherwise required by applicable law.
